Death of a Heir

My mother recently died and left her estate to my brother and I.

Before the estate could be settled my brother died, and on his death bed he drafted a new will disinheriting his son and grandson then left his estate to the church. Does his share of our mothers estate go to the church?

That depends on your Mother's Will. You should ask the attorney who is handling the estate this question but from your stating of the facts I say it goes to the church.
