Legal Question in Wills and Trusts in Indiana

My father past away over three years ago in another country and his estate has still not gone through probate. The attorney in the other country handling the case past away and when questioning what is going on I get an unsatisfactory response. There is realestate and bank accounts invoved but also intellectual property which, as his only heir, is mine. The overseas patent attorney says I cannot move forward until after probate. I have already had someone build $500,000 worth of goods to one of his designs without paying royalty when I requested. There are other designs more valuable.

My question is: can I file for probate here in Indiana where nI live? I am a U.S. citizen and so was my father.

If he was a citizen of the United States and a resident of Indiana, regardless of where he passed away, you can open an estate in the state of Indiana. Indeed, in order to secure his estate, you absolutely must open an estate.
