Heirs Denied Inheritance

My children's paternal grandmother died in September 2004 in Lafayette, Indiana. I was told that she had left no Will. In October 2004, my husband's siblings filed for administration of her estate. I wrote to their lawyer and attempted to add my children to this case. Then I was told in December 2004 that a Will was located and that only my husband's siblings were named therein. I sent several certified letters to their attorney requesting a copy of this Will. This is April 2005 and I have not received a copy of the Will yet. I checked and no Will has been filed either. Is there any way that a claim could be made in the absence of my deceased husband being named? I would assume that if a Will existed there would be a time frame in which to file such a document. Is this some trickery to exclude my children from claiming their inheritance? Off the cuff, a neighbor suggested that I do a Petition to Determine Heirship. Thank you for your advice with this matter.

You need to pose this question to an Indiana attorney.

And you need to get access to the probate proceeding in Indiana. If you check with the probate court in the county of residence (or death), they should be able to tell you if a probate action is pending.
