Legal Question in Wills and Trusts in Indiana

legal help or probate needed?

Mu Uncle just died. My Aunt has little money. The only assets are the free and clear house held as joint tenants, joint bank accounts with little cash in them, some cars and personal items. There is no Will. There are 5 children. In Indiana, can my Aunt do as she wishes with the assets? Is Probate necessary? Should she do anything to protect herself?

Probate is probably unnecessary. Most of the assets were set up to transfer without a Will. That is the house and bank accounts were jointly held. There is a method for small estates via affidavit. Your aunt should see an attorney to get this done. She will also need to have an affidavit done for the Indiana Department of Revenue showing that no inheritance tax is due.
