If my parents are purchasing land but do not own it outright (paying mortgage) am I able to purchase and acre from them to build a house on?

1. Yes, if it is OK with their mortgage company and the money is applied to the mortgage, if that's what the company wants.

2. Yes, assuming you comply with local zoning as to splitting off an acre for such a purpose.
