Probate/estate Indiana

My divorced father passed away. My sister and I are handling what we know. We are selling his condo soon. Do we HAVE to file through probate or establish an estate? He had no will. There is a small amount of debt to credit cards. What will happen with the credit debt if not paid? Who is responsible? What requires us by law to establish an estate?

What requires the opening of an estate? The ability to transfer real estate and car titles not jointly titled to you and your sister. Unless you are or your sister have joint ownership on the condo, I do not think you can sell it. Certainly not sell it without the possibility of some very expensive problems. Whether you can file as a small estate and other issues will need you talk with an attorney rather than use this forum.
