Re: Removal of Executrix
You need to speak with a real lawyer located where the subject estate is being probated, because different probate judges have different ways of conducting business. In Marion County (Indianapolis)a person with an interest in the estate must file a petition with the probate court to remove the personal representative. The petition must state valid grounds for removal -- such as conflict of interest, failure to account, or other bad behavior. Your upfront costs can't be calculated until you speak with the lawyer. If your petition is successful, then a new administrator will be appointed, who will be paid from the assets in the estate, which could diminish the funds available for distribution to beneficiaries. Good luck.
