Legal Question in Wills and Trusts in Indiana

Requesting a copy of will from Executor

My father told me he has a will and told other family members, My half brother is the executor of his will. There are things being sold and given away by my step mother and taken by half brother and now it's being said the grandchildren will not get what was left for them. By Indiana law can we force our half brother to give us a copy of the will? He will not even talk about it. Or make him probate the will? My father just passed 2002. I would just like to make sure this is stoped before it's to late.

Thank You.

Re: Requesting a copy of will from Executor

YOU have standing to open an estate if your brother who is the executor (now called personal representative) is not doing his job.

If he has already opened an estate, then that court file is public record, and you can go examine its contents if your brother won't share that with you voluntarily.

Hope this helps answer your question.
