Legal Question in Wills and Trusts in Indiana

State of Indiana will not issue a marriage to any one who has been declared incompetent. If you reside in Indiana and marry out of state but return to the state of Indiana to live, then the marriage is void. Same applies if a person is marrying out of state to elude certain other laws. If a said woman does this and the marriage is bad because of her abusive behavior and a divorce is filed in less than three years, the husband dies a week or so before the divorce is final, she inherits close to 3 million dollars. He wanted his death investigated if he did die because of her threats, but somehow she kept that from happening. Question is: Is the marriage still fraudulent? Would it rule her out of being beneficiary to Life insurance because it says to my wife or spouse, which she would not be if the marriage was void? She had him change the will to her as executor however, the children names were mentioned so they could not contest that they were left out of the will. It all seems like a plan of events. She also has a violent past. Or is there any case? She keeps taking them to court to try to make them pay for the funeral and other expenses as well when she got everything.

Yes, sounds very suspicious. The children can hire an attorney to advise them on these issues; it would be tough to answer this for a third party (you) without knowing more.
