Legal Question in Wills and Trusts in Indiana
No will, no disputes
My mother just died, with no will (her husband already dead).
My brother (her oldest son) lived with her and we all helped take care of her.
She owned her home and land (prob less than 50k value total). We would like the oldest brother to keep the house and some of the land, with some others getting some of the land. Is this possible?
Bank account in her name only..?
Some money in credit union joint account with one of her daughters, most money in it would be used for funeral expenses, if allowed.
Also, her car (paid for)....in her name only. How can someone else get it?
We (children) all get along well, and could probably divide stuff up if law allows, does it?

Re: No will, no disputes
The children can divide up the estate in this case in any manner they see fit, so long as they all agree. Since the value is over $25,000, a personal representative must be appointed by the court and the children can agree for an unsupervised administration.
