Legal Question in Wills and Trusts in Indiana
Last Will & Testament
My mother's husband has a Will and he has asked his sister to hold it. His sister lives in another state. He has kept this Will secret and will not discuss it's contents. We believe that he has not provided for our mother, in the event of his death or entry onto nursing care. We also believe that he has hidden savings, probably in another state, and he intends to keep it hidden, even if he or she needs nursing care. Both he and my mother are elderly and failing. My mother has Alzheimer's and he is on the leading edge of dementia. My mother has a small savings, but it will quickly disappear when nursing care starts for either. All of my mother's savings and intentions are known to us, but all of her husband's are not. It will be her savings that is exhausted, if either goes into nursing care. We believe he will expect us to care for him, if my mother should pass away or enter a nursing care. We also believe that he will refuse to help pay for her nursing care, even though he may have hidden resources. We would like to know if there is a way to force him to expose his Will, so we can make the appropriate decisions for his care, should their medical conditions change.
