A Four Year Old Will

My Mother left me money in a will 4 years ago when she died. One of my brothers or sisters (I'm not sure which) was the executor and supposed to get me my money, but I never received any. Can I still claim this money? Do I still have rights to it?

If you were a beneficiary in your mother's Will, by statute, the executor should have mailed you a true copy of that Will within 60 days of it being filed with the Surrogate's Office. If you didn't get a copy go to the Surrogate and obtain one. If you were named as a beneficiary, ask who was appointed executor (sometimes the first person named in the Will doesn't accept) and obtain his/her address. Then, contact the executor and inquire as to what's going on. Although there's no set time for administering an estate, 4 years seems awfully long unless there were a lot of complications. Still, you should have received some sort of update from the executor and since you have not, you're entitled to ask and receive information about the status of the estate.

Executors are appointed by a local court and must answer to the court. Check at the court to see what the status of the estate is.
