Legal Question in Workers Comp in Indiana
a work related injury, what are my rights?
I have seen a total of 5 doctors and have had a bone scan, MRI and an EMG. tests reveal that I have 3 buldging disks and nerve damage. This was caused by lifting a roll of paper at 165lbs. approx. which is alot of weight considering i am a female at 120lbs. Each doctor refered me to the next. My family dr. sent me to a pain clinic, the dr. there did an MRI and an epideral and said i needed to see a neuroligist. The neuroligist concluded I would have to just live with the pain without even really examining me. I then expressed that I was not satisfied with him to workers comp. They then agreed to send me to another, he said I need surgery after ordering am EMG and found nerve damage. Now that workers comp has these results and has been told that I need the surgery, they will not approve it. I am not sure what to do, because I am severe pain and do not want to try other methods like therapy. This has been going on for 3 months and has worsened. My legs are falling asleep all the time. This ahs affected every aspect of my life and they just keep givving a hard time and actually try to diagnois me in spite of the medical records. Please tell me am I entitled to this surgery, and can I do to get it? Thank You for your time.

I am usure of the laws in your state, but it seems
to me that you are getting the run around. I would
contact an experienced workman's comp attorney immediately
before your condition worsens. You will not get the
treatment you need until an attorney gets involved.
They have already dragged this on for 3 months don't
sacrifice your health by trying to get through to them.
They are not there to help you only to burn you out.
