Legal Question in Disability Law in Iowa
I had a full time day position at a local hospital. I have an adult disabled daughter who lives at home with us and had to leave my job due to schedule changes I could not commit to. ( I had no caregiver for the evening hours) I explained this to my supervisior and expressed my situation clearly. I recieved an email from this supervisior stating the schedule changes. I would work "swing shift" with another employee who wanted her former position back. ( I was put in her former position because of my abilities with computers. I did not ask for it. The Director of Nurse's at that time felt my abilities would benefit the hospital.) The new schedule changes were also benificial to a student who began working. Her schedule was difficult due to her commitment to both her education and employer. She asked to work only weekends. I had no choice or say in my schedule at all. All was said and done without regard to my family commitment to care for my daughter. I attempted to recieve unemployment. I was made to cut through red tape in order to get this. The decission was made that I was allowed to get unemployment because " of a change in the contract in which I was hired. My leaving was caused by my employer." Legal Reference: Iowa administration code 871-24.26(1)
So by this statement it agrees that a discrimination act was made by my employer. Am I able to get compensation for this?
Thank you for your service.
