Legal Question in Administrative Law in Iowa
If a utility board of trustees doesn't follow the procedures outlined in Code of Iowa 380.3 when establishing rates, demand charge, etc.....is their rate hike legal and binding? (Example: didn't vote all three times on each reading) There's more and many such as a 3 man board waiving the 2nd and 3rd readings with one member dissenting for a 2/3 majority instead of the mandated 3/4. Can these established new rates and/or newly created rules be challenged as non-binding?
