Legal Question in Appeals and Writs in Iowa
Challenging state custody decision
My wife went to Illinois taking my son after we had only been in Iowa for 6 weeks. She filed divorce 14 days later instead of the required 90 days. My attorney talked me into signing a venue waiver because I could not file in Iowa for a year. We went through an evaluation, which she lied big time on. I have writing from her tell how her home life was there with her parents but my lawyer did not file it as discovery and the judge refused to read it. My wife got custody based on the evaluation. Can I refile in Iowa?

The short answer is no, because you signed a venue waiver.
