Is a legal agreement binding? Does this vary state to state?

Yes legal arguments are binding, unless there is a legal reason for it not to be binding. You see your question is similar to asking the question whether all people breath air. Yes unless they there is a reason not to breathe the air. Then they don't. Be more specific, like, do people under water breath?
