Legal Question in Business Law in Iowa

I'm a member of a gym here in Iowa and recently used their tennis courts. A month later I received a bill from them for Tennis Court Fees, which I never knew existed because I never saw anything posted about it.

When I contacted a representative of the athletic club they told me that there is a fee for playing tennis. When I asked what the rate was they said that it depended on the day, time of day, and amount of people playing. She totaled up what she thought I should have been charged for that day and it was incorrect, which lead me to believe they are able to charge whatever they want.

In no location of the facility is price information displayed and to me this just seems like it is a violation and that if you are going to charge people a fee for using a facility the fee should be known and if a rate is calculated based on the information they told me over the phone I would think legally it should be displayed. Not calculated behind the scenes.

I'm no lawyer, but I would think this would have potential for not only a law suit but a class action law suit from all people who have been paying tennis fees at this location.

Have you reviewed your membership agreement? Have you asked the gym to provide you with information? If they haven't done that you might be able to sue them in small claims court.

Class actions rarely get past jump street and are seriously labor intensive.
