Legal Question in Business Law in Iowa
possession of tractor
A repair shop has had my tractor for 3 years and has not repaired the tractor. I want to remove the tractor from the shop and owner claims he has a mechanic lien on it and will not release it unless we buy the parts he has ordered to repair it but has never put on it. What rights do I have? BTW, rumor has it that he has filled bankruptcy.Thank-you for your help.

Re: possession of tractor
First thing to do is check at the county courthouse and see if he has filed a mechanic's lien. A lot of folks say such things but rarely follow through. In addition, you need to check with the clerk of the bankruptcy court to find out whether he has filed for bankruptcy-because if he has, your life just got more complicated. If you need further information give a call.
