Legal Question in Civil Rights Law in Iowa
Bounced Checks
I bounced two checks in June 2005. I attempted to pay for them when i got served to do so in October 2005. They refused to accept payment and gave me a receipt that said they would not accept payment. I heard nothing more on this matter until 10/2006 when i was arrested in my home. While being arrested, my fiance ran over and they accepted payment on the checks. They even wrote on the receipt that they did not wish to press charges. (Local grocery chain Hy-Vee). After i paid for bail, i examined the papers to find out that i was arrested for the wrong check amounts, wrong dates, Hy-vee charged and accepted the wrong (Higher) amount in payment. The DA called and said i could pay court costs and she would call it even. Hy-vee would not accept payment a year ago, I have been overcharged, paid a bail fee and was threatened by the DA to pay or the cost would be higher because she had to supinea people. I dont want this on my record and i am owed money. What can i do? What are my options? Thanks, Donna

Re: Bounced Checks
You have no options.
All those things you identify go to the weight of the evidence and they will not serve to make the charge go away if true.
