Dog Death

Today I let my sons shitzu outside and we have a St.Bernard that is in heat. The neighbors dog which is German Shep. came across the yard and I was yelling for my shitzu to come inside as he was coming inside the neighbors dog attacked him after taking him to the vet he had to be put down. I talked to the neighbor and asked them to pay to replace my childrens dog. The lady said she would and her husband said not a chance that its my problem not theirs. I called the police and they said its a civil matter. If i go to court to get the money to replace my sons dog would I win. I was willing to have them pay half the value of my sons dog in which i paid 5hundred for. He husband said NO WAY would he replace the dog...Keep in mind this all took place right before my eyes. In our yard. Any ideas?? This was my sons male dog and he was used for breeding purpose. I also have a female. I am upset that I was willing to work with them and his wife agreed but he said no..I even told them i would replace the dog and they could pay payments to me. He began to scream and said he will never pay for another dog and if i take them to court he still wont pay. HELP PLEASE....The worst part is money will repalce the dog but not the kids feelings...

You can file an action in small claims court.
