Legal Question in Civil Rights Law in Iowa
I'm in Iowa where same sex marriage is legal. We are getting married today and I'd like to add my spouse to my medical and dental benefits, under my employers plan(no open enrollment) I can only do so with a qualifing event ie marriage,birth,death ect...
I just recieved an email stating that they don't consider same sex marriages as a "qualifing" event.....I became eligible on 1/1/10-5days ago. the company is saying if we were already married i could have had him added to my insurance?? Can this be right?? seems to be discrimagating no??
Also---5 days?? they can't "forgive the 5 days"??

I think you've got a fight on your hands, although because the state says same sex marriage is legal does not compel the insurance company to insure people who have done that.
No doubt other people find themselves in the same situation. I suggest you contact one of the advocacy law shops like Lambda Legal Fund and see what they can tell you.
