Cellphone Insurance Question

I purchased a cellphone with a loss/damage replacement policy a couple of months ago. Yesterday when crossing a busy street, it fell off my belt clip into the street and got ran over. I filed a claim and they rejected it stating negligence. My contention is that it was an accident and I had done everything reasonably expected to take care of the phone. Their policy has a list of exclusions and the only thing that I see in it mentioning negligence deals with negligent loss. I didn't lose the phone, it is just severely damaged. What recourse do I have?

Need to see policy (contract) to advise, but you could appeal to customer svc supervisor in writing (with a cc to your atty) or maker claim to state ins or commerce commr.
