Legal Question in Consumer Law in Iowa

Someone I know is in a contract

The contract is to buy a house and it is legal and binding(according to a lawyer), however the seller didn--name removed--have legal rights to sell the house because the bank has it (the title) due to the loan taken out on it (which wasn--name removed--known at the time of signing). It was put on contract without the bank knowing about it, now the seller wants to void the contract but the buyer wants to keep it, what are the buyers rights to keep the house and get the seller with fraud. The contract states that the seller has a free and clear title and will present it to the buyer when contract is paid in full.
