Legal Question in Consumer Law in Iowa

false advertsing on the internet

I found a horse in New Sharon, Iowa. It was advertised as ''broke for any rider''. We bought the horse and the horse is not broke for any rider. I understand I have no legal standing since there is not a signed contract or any stipulations the horse can be returned after purchase. However, we contacted the seller as soon as we found out the hose could not be ridden safely. She advised to return the horse and trade for another one. However, everytime we arrange to do so. She says she has nothing to trade for. What are my options if any?

Re: false advertsing on the internet

You may have claims for fraud or deceptive trade practices based upon the false representation that the horse was broke for any rider. Whether that statement would be viewed as an actionable misrepresentation of material fact rather than a statement of opinion, may depend upon experience of the seller, whether the seller is in that line of business.
