Legal Question in Consumer Law in Iowa

IPERS for the tate ofIowa has taken a past employees IPERS money aand the person worked fo the city of dav for over 27 years. The inidividual collected ONE MONT o his IPETRS and then became deceasd. The beneficiries then loose all monies that was paid into his/indivdiuals IPERS and IPERS says that all those funds revert back into their IPERS general pension account!!!! All funds reverted back to the IPERs fund due to a checked box by the now deceasd past employee who was given n assistance per city of davenport on what each ine item means. I mea eally, I can think of I do not feel that it s proper or legal forIPERS to e able to retan over 90000.00 of this persons money after he worked all those years and the family memberscannot collect those funds, when they 1. went into debt paying for his burial. 2. Nomoney to pay for a headstone for that same individual. 3. The annual salary that the director of IPERS collects and families are left in this hardship situation. 4. The way that the final paper work is described for the employess parting emploees to figure out the legal words of this cumbersome and confusing form to be literlly jilted out f their funds and the money going ack into a fundfor IPERS and goes who know where. No lawyers locallywanted to "go against IPERS" as stated dueto their magnitude of power. I feel it should be reviewed and investgated thourghly. Please help, not just for my family but fr others wom may someday or have been faced with this same dilema. . Wilma Drummond; 563-505-3068

I think that's the general rule. Had this person not taken IPERS benefits that money could have been withdrawn, but as it is, that person received benefits, even for a short time.
