Legal Question in Consumer Law in Iowa

Paying a portion of an invoice

My mother-in-law lives in Iowa. She told us she needed a $100 repair to her furnace, and we said we would help her pay for the repair, expecting it to be around $200.00 with the cost of labor. After checking the furnace again, the repair man said her furnace couldn't be repaired. Without consulting us, she told the man to install the furnace and send the bill ($1400.00) to us. We are willing give her $200.00 toward the bill. If we get a bill from the furnace installer, what should we do with it? Will paying $200.00 directly to the installer make us responsible for the entire bill?

Re: Paying a portion of an invoice

No, paying a portion of the invoice will not make you liable for the remainder. Unless you made a contract with the furnance guy to fix or replace the furnance, he has no basis to attempt to recovery from you.

On a different note, the furnance installer will get paid one way or another. Lien foreclosure law, at least in Michigan, would allow him to file a claim of lien against the house and to later file a suit to foreclose on the lien, which could ultimately lead to a foreclosure sale of the house to satisfy the lien. It's far better to see that the lienor is paid as soon as possible.
