Legal Question in Consumer Law in Iowa
return after 30 days
My boyfriend and I purchased an engagement ring. It has had to be sent in for various repairs 6 times. Each time it comes back with new nicks or scratches or dents in it. The return policy was for 30 days. We are about 45 days past the original 30 days, but we have never ''accepted'' the ring as satisfactory. The sales woman kept telling us to take it home and see how we felt. We brought it back every time. We are finally fed up and want our money back, but they are saying it is past the original 30 days. Are we stuck with the ring because we gave them the benefit of the doubt and allowed them to attempt to fix it so many times? Thank you!

Re: return after 30 days
No, you are not stuck with the ring. Go back tot he store and insist that they provide you with a conforming ring. otherwise, you'll have to sue them and argue that the ring was never acceptable and they failed to provide what you purchased. Chances are, rather than risk their reputation, they'll give you your money back.
In the future, don't wait, if at 29 days, it's not satisfactory, insist on the return of all money. If they then want to fix it, tell them that you will reconsider the sale when the ring meets your needs.
If, however, the ring is a custom ring, they may be entitled to have it fixed by someone else.
