Legal Question in Credit and Debt Law in Iowa
Credit Card debt
I have received a letter from a collection firm stating I owe them money from a credit card from 2002. I did have some credit problems then but took out a consolidation loan in 2002 and paid this card off or so I thought. I sent a check for the balance of the last statement and that was the last I heard from the company. Now, 2 1/2 years later I get this letter stating I owe over $300.00. The card was cut up at the time and I never received any correspondence from this company until this debt was sold to someone else. I am trying to get information from them as to what the balance consists of and they are telling me they do not have to supply that information to me, it is my problem. How can I be expected to pay this debt if I don't know what it was for? I have sent them copies of the last check I wrote to them but I did not keep a copy of my last statement showing that balance. My credit report from that time showed that outstanding balance also. Is there anything I can do to get this company to cooperate with me? I have spoke with numerous people at their phone number and sent several faxes and I still am getting letters stating ''their efforts to resolve this are apparently going unnoticed''

Re: Credit Card debt
Sounds like a violation of the Fair Debt Collection Practices Act. They are required to validate the debt upon request under the Act. However, without reviewing the relevant documents I cannot say for certain. If you are in the Quad City area, I would be happy to assist.
