Legal Question in Credit and Debt Law in Iowa

Credit card issued in my name to someone else

Hi,

It seems a credit card company has issued a credit card to someone else in my name. They were mailing out a lot of those credit card offers and my girlfriend may have filled one out and put down her address. I have never done business with this credit card company. I found this out during a credit check on my credit. I realize that they were deceived but they issued the card without any ID whatsoever. This is really stupid. I could not cash a check for $10.00 at their place of business without an ID. How can they issue $1000 of credit in my name without at least some proof? Is there any way that I can hold the credit card company liable in a court of law for their part in this mess?

If they issued the card without your consent, you are not liable for it. However, if you ever used it, or knew about it and didn't do anything to stop it, then you can be sure they will argue that you ARE liable. Either you allowed your girlfriend to do it or you didn't, --either way you should be able to prove it.

You can do a few things: 1) file a police report for identity theft (if you didn't allow her to do it), 2) notify the credit card company in writing that you contest the charges because of identity theft and 3) follow through until your credit revord is cleared.
