Legal Question in Credit and Debt Law in Iowa

not my credit cards!

I have an ex whom I only dated for a couple months and have been broken up with for over a year now. He got 3 credit cards solely in his name while we dated and said I could get things on them if I agreed to help him pay for the cards. I have paid on them for a year to help him out, but it is putting me in a horrible place financially. He's now saying I need to pay the balances of the 3 cards which totals around $2000. I can't even make the minimums now, nor do I want to because he's been so horrible about this. He's threatening that if I don't pay the cards he's going to take me to court, which I didn't think was possible since the cards are not in my name and I don't even have the credit cards...never did. He says I sent him an email a long time ago stating that I would pay the cards off, but I can't remember doing that. My question is: can he take me to court for this at all, even if I did send him an email long ago. He swears he can but I feel like he's bluffing. I just need to know.

Re: not my credit cards!

It sounds like he is "bluffing", and remember the burden of PROOF is on him as a plaintiff in an action. He may have some legal arguments even if your name is not on the card, especially if you two had some sort of financial agreement between you both to pay the cards off together (50/50 per se). However, the legal presumptions are in your favor if you are not named on the credit card accounts and he cannot rebut the presumptions with substantial proof otherwise. So, he may be able to file suit here, depending on his evidence and arguments, but it sounds more like a bluff. If you would like a free phone consultation to give us more facts, contact us today.
