Legal Question in Credit and Debt Law in Iowa

Debt Collection-Judgement and SOL

Hi. I had an old CC debt from 2/98. It was charged off and sold to a Collection Agency. The original amount was $800. The CA filed a judgement against me in 2004 for $1400. When I sold my house in 2006 I had to settle all judgements. The CA would only release the lien for $3100.

I live in Iowa. Did the CA file a judgement outside of the SOL on debt collection? If they did, how is that possible?

thanks in advance,

Erin

Re: Debt Collection-Judgement and SOL

Generally, the statute of limitations on written agreements is ten years. The judgment lien that they obtained in 2004 can be enforced for ten years after that.
