What evidence should I bring to a small claims hearing where I am the defendant? What should I say to the judge? I am one of two defendants on a small claims case. A collection agency has filed a money judgement against me and this other person for a debt owed to an apartment complex. This other person moved out of state. i accepted in part to this claim because I don't feel I should pay the whole thing and the agency cannot get a hold of this other person. This other person won't be served since they live out of state. I now have to attend a hearing and need advice.

Without seeing your lease agreement, it is difficult to make any suggestions. Generally, the two of you would be jointly and severally liable for the debt. This means that the landlord can try to get the money from either one of you or both of you. Not sure what county, but most have mediation before the trial. You might try to work something out with the landlord there. If that does not work, you may need to track down your co-tenant and sue him or her. But again, without seeing your lease agreement, this is all just conjecture.
