if your husband is not paying his bills, can they come after the wife for what he owes if wife's name in not any of the bills?

I used to think the answer to this was yes, until I got my head handed to me by a judge in Marshall County. Here's the code section that was the platter my head was handed to me on. If the credit card was used for items other than necessaries you're not obligated if your attorney's smart enough to figure this one out. I am now.

597.17 LIABILITY FOR SEPARATE DEBTS.

Neither husband nor wife is liable for the debts or liabilities of

the other incurred before marriage, and, except as herein otherwise

declared, they are not liable for the debts of each other contracted

after marriage; nor are the wages, earnings, or property of either,

nor is the rent or income of the property of either, liable for the

separate debts of the other.
