Legal Question in Credit and Debt Law in Iowa

Privacy invasion?

I was recently working with a creditor to pay off some past due bills and they were helping me by giving me some payment options and waiving some of the late fees. I screwed up and missed a payment by a couple days. I got a bit nervous and called my mother (who works in a loan dept. in a local bank) to see what they could do. She called them (unbeknownst to me) and they not only told her that the excess payment had been written off, but also what the current payoff is. This is infuriating! Do they have the right to give someone else that info?

Re: Privacy invasion?

No, they don't have the right to give that information out to anonymous callers, but, on the

other hand, they probably could have declared you in default if they had wanted to(for being late with your payment)and initiated collection measures.
