Legal Question in Credit and Debt Law in Iowa

Statute of Limitations on rapid refund loan

My husband did a refund anticipation loan with H&R in Iowa in 1995, his taxes were done incorrectly and we had to pay into the irs. He got a letter stating he owed the refund amt and fees to the finance company but never responded or paid. After several years of not getting anymore bills he just received one. He sent a letter of dispute, but they responded with proof of the loan. What is the statute of limitations if he never paid and never made a promise to pay. We now live in Wisconsin since 1996.

Re: Statute of Limitations on rapid refund loan

The statute of limitations is most likely 10 years. I can't imagine they gave you a loan without requiring a promise to pay. Depending on the amount in dispute, it would probably be a very good idea to have an attorney review the relevant documents.
