Legal Question in Credit and Debt Law in Iowa

thanks you thomas. It is my name and adress. I had not known that it went to court, and it is in the courthouse now, and it is on my credit. They have tried to garnish my check, but were unable to becasue of my low income. What else can I do to get rid of them? It was not my card, someone else must have used all of my info to get it. I think I know whom that was, but she lives now far away. I do not intend on paying it, but since it already went to court, can I take it to court to say it was not mine, and to proove it was not? what can I do to get rid of it?

I'm not sure of the context but if it has already gone to judgment and garnishment you're more or less stuck with it. You had your opportunity to contest it and that sounds like he said she said speculation. If you really and truly were not served process you might be able to try and back out of it if you have a good lawyer-but one might think that you knew about it from the time that they tried to garnish you and did nothing.
