Legal Question in Credit and Debt Law in Iowa

Vehicle Repair Dispute

Can a auto repair shop keep your vehicle until payment is made? Our vehicle was taken in for repair, we have an extended warranty and wanted them to make sure that the warranty covered it first. They are claiming they did not know about the warranty until after the work was started, when we have an individual that heard my husband say that there was a warranty. It turned out the warranty did not cover the repair and now we have a $1200 bill we cannot pay. I've asked them to set up payments but they are unwilling to do that. They have the vehicle and will not release it until it is paid in full. There was no mention of the vehicle being paid in full until after the work was completed. Is there anything we can do legally to get our vehicle?

Yes, it is called a Possessory Lien, and protects mechanics etc from loss of repair compensation.
