Legal Question in Credit and Debt Law in Iowa
wage garnishment- when will it end?
In 2000 my husband and I were in terrible financial trouble and consequently had a van repossesed. It was told to us to to pay the entire amount due, not just catch up 2 months of payments. Of course we were unable to come up with 13,000.00 in 5 days. In 2004 a collection agency in a lawyers office has now place a judgement against us and is garnishing my husbands wages. The original amount was 7000.00. The collection agency garnishes wages for about 4 weeks (enough to get about 1000.00} and then will stop collections for about 3 months, resume. Each time they have resumed collections, the amount has actually increased! We now owe 9000.00. In my opinion I think they are just obtaining interest, and allowing interest to build and restarting the cycle. We do not want to file bankrupcy, but I am at a loss as what to do. I am asking if this is legal, and what can I do about it? They have done the ''cycle'' 3 times, each time my husband was severed papers at his employment. His employer is not happy and has threatened consequences if the matter is not resolved. Thank you for your help.

There are limitations on what can be garnished, and it is possible that that amount is not sufficient to cover the interest. Ask for an itemized statement.
