I am going to assume from your question that you or someone you know has been charged with conspiracy to deliver marijuana. I am also going to assume that what you are referring to is an application made by the prosecutor to destroy evidence and that the court has ordered its destruction. Often times, prosecutors argue that marijuana is not a substance that should be preserved during a pending prosecution because of the manner in which it deteriorates. A defendant always has a due process right to preserve, examine and test evidence. If this is the situation, you should consult with an attorney immediately.
