Beth's accident

my daughter had a car accident and is in the process of being sued. I find out from the laywer that is representing her that a different doctor in our clinic made a statement on the lady's chart that ''she was a very unfortinate lady who was hit by somebody who was high on drugs.'' How does he have the right to make that judgement when he was not the er attending doctor or her regular doctor? Do I have the right to sue him for wrong information being given to the public? My daughter was in the wrong when she hit her, but that doesn't give the doctor the right to make that kind of statement without the blood work and accident report, and since he is not her doctor, he has no business in her medical file. I would like to sue him for false acqusations? What can I do?

First of all, it's not criminal law, its civil law. Second of all, it's not your problem and you have no standing. Your daughter is the one being sued not you. If it is necessary her attorney can and will impeach the witness. I suggest you take note of this and raise it at the proper time if the case ever gets to court.
