Case dismissed, still requesting civil demand

Hi,

I was accused of Theft in the 5th. The case was dismissed twice. Once by the judge as the original paperwork was not there, and second by the County Attorney and for all charges to be off of my record. The County Attorney said I should not be held responsible for a civil demand as no merchandise was taken, and an attorney I work for said the same thing. I still received a civil demand letter and don't think I should have to pay because 1)the case was dismissed and 2) no merchandise was taken. I would like to get another attorney's opinion. I have a formal letter written and plan on faxing it to the legal office of the store tomorrow. Thanks!

They're going to have to sue you to collect anything, but on the other hand they can wreck your credit.

I'd be inclined to send your letter return receipt, maybe the attorney you work for would like to send it.
