Legal Question in Criminal Law in Iowa
in a domestic assault where the victim/spouse doesn't want to testify can they be held legaly responsible, even if there subpoened?

It is possible but rarely happens. On the other hand an offender assumes a lot if he or she thinks that because the victim doesn't testify that they're going to get off scot free.
