Legal Question in Criminal Law in Iowa
Driver's responsibility
Hello, I was recently pulled over and the cops asked to search my car and friends. One of my friends had pot on him and hid it in my car. The cops found it and charged me with possession. I've asked my friend to come out and say that it belonged to him, but he says that it wouldnt get me out of trouble since I was driving. I was wondering what the driver's responsibilty is when it comes to situations like this. If my buddy told the police that the pot belonged to him would I still be trouble?
Thank you.

Re: Driver's responsibility
If the contraband was within your reach and control it is considered constructive possession. It's a factual issue and you should make sure and get competent counsel to defend your rights if you think you can prove the stuff was not yours.
