Legal Question in Criminal Law in Iowa
evidence
Hello again: I first submitted a question (9/22/05 ''assault'') and you responded..thank you. As far as evidence, my daughter had a scrape on the rear bumper as well as damage to the front driver side door, which was ''scrunched'' inward causing the inside panel to buckle out.(The door saved my daughter from getting hit as she was standing between the door and the driver seat.)They have the recorded 911 call made by my daughter. There was a witness stating that my daughter was being followed by the other. My daughter's ''new'' boyfriend was with her. The other driver was an ex-girlfriend. The officer stated in his report that it was a clear case of road rage, unable to determine who was at fault. My daughter is not disputing the fact that she assaulted the woman. (although she fought with the other two after she tried to run my daughter over, a second time. But, my daughter also had visible injuries; pictures were taken. The passenger admitted in her statement that they hit my daughter's car. The sergeant on duty that night knows the other women's families..but I won't comment anymore on that. Except that he's the one that told her, being sacastic, ''good luck getting your car fixed.'' They treated her unfairly. Thank you for your time.
