Legal Question in Criminal Law in Iowa

Felony vs. Assault

I was arrested for burglary 1st for allegedly forcefully entering an occupied structure w/out permission and causing bodily injury. The thing is, guilty ot not guilty, I have a key to the house, which is my kids' grandparents house. I have an open-door invitation at all times. How can it be a burglary if i have permission at all times? The plaintiff doesnt even reside there. The police have only gotten her statement. They havent even questionsed the owners of the residence. Shouldnt it be Assault ..either simple or with intent to do bodily injury??? I am so confused as to how this charge was even filed??? please help. The only record i have is a owi and driving revocation and a no-contact violation (i was the protected party)

I do not know from what you've told me why you think you should be charged with assault instead of what you were charged with. I think if you have not retained an attorney to defend you you should do so immediately.
