Legal Question in Criminal Law in Iowa
I have a friend incarcerated in Anamosa, IA. These are his words he wrote me to ask you: If someone were originally sentenced on 8/10/05 to 10 years prison (suspended), 5 years supervised probation then commited another crime later that year but wasn't sentenced for that crime until 8/17/06 along with the probation violation and the judge gave that individual credit for time spent in jail, does that time credit also cover the 10 years suspended/5 years probation go back to the time he was originally convicted on 8/10/05 since the individual was on probation since that time? We live in Iowa. Thank you so much.

The credit for time served for the second offense is not concurrent with the original sentence that was imposed upon revocation of probation, unless the court so ordered.
