Legal Question in Criminal Law in Iowa
My friend is on medication for by-polar disorder the doctor gave him ambien. After taking medication he went to a bar and drank. He became disoriented, walked home and accidently walked into neighbors garage. The owner called the cops, then confronted him. The got into fight the home owner got black eye and some bruises,then he fled. They are charging him with robbery1st. Why are they charging him with robbery if he had no intention of taking anything? What is best defence?

He needs a good attorney. Let's break it down...he got loaded, entered a person's home without permission and then assaulted that person, inflicting bodily injuries. The 'I was drunk at the time' excuse never works if, as in this case, it was self inflicted.
Secondly, because intent is rarely susceptible of direct proof, it is inferred from the facts and circumstances surrounding the incident.
The best defense is to get the best deal you can get.
