Legal Question in Criminal Law in Iowa
my husband was arrested booked and charged with Trespassing, possession with the intent to deliver. and tax stamp. He was wrongly accused of the drug charges. He 1 pain pill in his pocket at the time of arrest. His 81 year old mom gave him one of these pills that was her prescription for his tooth ache. He has very few teeth left none of them are any good so he has major pain. She intends to tell the lawyer she gave it to him will she get in trouble?????

It really wouldn't matter how he acquired the one pain pill, but for possession with intent and tax stamp violation there's more to this story that isn't being told.
It sounds like your asking if his mother will get in trouble for providing prescription medications to someone else. Potentially, yes. Delivery of prescription medication without a prescription is a felony.
