my husband and i was arrested sept. 7 him for owi me for public intox but i was driving and have been convicted of public intox his case is pending if i admitted i was driving can i still be charged with owi after a month and a half

Yes. Double jeopardy would not apply as it is a separate offense arising out of the same facts.
